Scotland tightens planning rules for hyperscale data centres

Environmental assessments required above 50 megawatts as Holyrood weighs moratorium, grid capacity becomes the scarce input behind AI growth

Scotland will require environmental impact assessments for large-scale data centres, applying the rule to projects with power capacity above 50 megawatts, according to the Standard and the Independent. Public finance minister Hannah Mary Goodlad announced the change ahead of a Holyrood debate on whether to impose a moratorium on new hyperscale developments.

The immediate fight is procedural—what must be studied before councils can approve projects—but the underlying constraint is physical. The Scottish Greens, who are pushing for a moratorium while a national strategy is written, argue that the first wave of proposals would consume electricity at a scale that makes the rest of the economy compete for capacity. Green MSP Patrick Harvie said that if the first 24 proposed hyperscale AI data-centre projects are approved, they would require one-and-a-half times Scotland’s entire peak electricity consumption.

Goodlad framed the assessment requirement as a way to “balance” economic and employment benefits against energy and climate goals, and to ensure significant environmental effects are considered from the outset. The government amendment described in both reports would allow new hyperscale sites only if they have met “robust” environmental assessment standards, rather than freezing the sector outright.

For developers, the new threshold formalises what has already become a de facto negotiation: access to power is now the scarce input, and planning permission is increasingly a proxy battle over grid prioritisation. A hyperscale facility can be presented as jobs and investment, but its operating model is to buy large blocks of electricity continuously, turning a local grid into a supply chain for remote customers.

The policy also hints at how AI infrastructure is reshaping regional industrial policy. When data centres arrive, they pull in transmission upgrades, land-use decisions, and political promises about “community wealth-building” that are hard to price and easy to dispute once construction begins. Campaigners have been lobbying MSPs, while the data-centre operator DataVita has invited politicians and a conservation charity to visit its site in North Lanarkshire, an effort to show that the industry is already embedded in daily digital life.

Holyrood’s debate is about whether Scotland should pause the rush or merely slow it down with paperwork. The new rule draws the line at 50 megawatts, then asks developers to explain where the power comes from.
